On September 1, 2021, a new Texas prostitution law was passed (stated in House Bill 1540) to make soliciting prostitution a felony. While it has always been illegal in Texas to exchange

money for sex, this new law sets stricter punishments. Under this new law, someone convicted of soliciting prostitution could face between 180 days and 2 years in prison, along with a fine of up to $10,000.

In Section 43.021 of House Bill 1540, someone is guilty of soliciting prostitution if “the person knowingly offers or agrees to pay a fee to another person for the purpose of engaging in sexual conduct with that person or another.”

Under this definition, it is not necessary for money to change hands, and there does not need to be any sexual acts performed for someone to be charged with soliciting prostitution. It is illegal to agree to payment in exchange for sex.
