Last week the Supreme Court blocked the Trump Administration’s move to end DACA (Deferred Action for Childhood Arrivals Program). This is a great victory for DACA recipients – the 700,000+ young immigrants who came here without the proper documents before the age of 16.This means they may continue to live, study and work in the United States without fear of deportation.
This is also very good news for potential DACA recipients. Since 2017, new applications have not been accepted, so qualified immigrants who had not applied previously did not have this protection. Now that the Supreme Court has vacated the decision to discontinue DACA, the USCIS (U.S. Citizenship and Immigration Services) should be accepting new applications soon.
If you meet all the requirements below, once your DACA application is accepted, you will be able to continue to reside, study and work in the United States with full legal protections. You are encouraged to apply as promptly as possible, since President Trump has announced his plans to rectify the Supreme Court’s objections and once again challenge this program.
Do you or does a family member qualify?
If you are an immigrant and meet the following requirements you may be able to apply:
Were under the age of 31 on or before June 15, 2012
Arrived in the U.S. before reaching your 16th birthday
Have continuously resided in the U.S. since June 15, 2007, up to the present time
Were physically present in the U.S. on June 15, 2012, and at the time you made your request for consideration of deferred action with USCIS;
Entered without inspection before June 15, 2012, or any lawful immigration status expired on or before June 15, 2012
Are currently enrolled in school, have graduated or obtained an equivalent completion from high school, have obtained a general education development (GED) certificate, or are honorably discharged from the U.S. Coast Guard or U.S. Armed Forces
Have not been convicted of a felony, significant misdemeanor, or three or more other misdemeanors and do not pose a threat to national security or public safety
